SIA LIVLY, 50203559181, Zirgu iela 7, Rīga, hereinafter – online store – provides the content available on the website and offers goods/services in accordance with the Terms of Use outlined below.

1. General Terms

If a consumer purchases goods/services through the website, such mutual agreement is considered a Distance Contract and is subject to the legal norms of the Republic of Latvia that regulate distance contracts, including but not limited to, the "Consumer Rights Protection Law" of the Republic of Latvia, and the Cabinet of Ministers regulations "Regulations on Distance Contracts" u.c.

2. Making a Purchase

The prices and specifications of the products sold in the online store are indicated next to the products.

To place an order, add the desired products to the shopping cart. Fill in all the required fields and choose the most suitable delivery method.The total cost of the order with delivery is then displayed on the screen. Make the payment to complete the order.

3. Payment Terms

The currency for transactions on the site is euro. Purchases can be paid for by choosing the following payment methods provided by the payment platform makecommerce.lv , Maksekeskus AS:

  • Latvian internet bank payments: Swedbank, SEB, Citadele, and Luminor
  • Estonian internet bank payments: Swedbank, SEB, Luminor
  • Lithuanian internet bank payments: Swedbank, SEB, and Luminor
  • Visa/Mastercard card payments

NB! When using the internet bank payment method, confirm the order and click the “Return to Merchant” button.

The personal data required for making the payment is transferred to the licensed payment institution Maksekeskus AS.

The contract comes into effect upon successful payment to the online store's bank account.If for any reason the order cannot be fulfilled, the Buyer will be informed, and the amount paid will be refunded as soon as possible, but no later than 14 days after receiving the notification.

4. Delivery Terms

Goods are delivered to the following countries: Latvia. The purchased goods are delivered using: DPD and Omniva. All fees and taxes that must be paid to receive the shipment at the delivery destination are to be covered by the Buyer. Delivery costs are displayed before order confirmation. The purchased goods are delivered to the address specified by the Buyer within 2-5 working days. In exceptional cases, we reserve the right to send the goods within 45 calendar days, informing the customer about it.

5. Right of Withdrawal

The Buyer has the right to withdraw from the goods within 14 calendar days from the moment of receiving the Goods. The right of withdrawal does not apply if the Buyer is a legal entity.

To exercise the 14-day right of withdrawal, the goods may only be used for their intended purposes, and the consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If the goods are improperly used or damaged, if the consumer is negligent in handling the goods during use or does not follow the instructions, if the original packaging of the goods is lost, or if the packaging is significantly damaged, opened, and already used, the online store has the right to reduce the refundable amount according to the decrease in the value of the goods.

The buyer bears the costs of returning the goods, except in cases where the reason for the return is that the goods do not match the order (for example, incorrect or damaged product).

The buyer is obliged to return the Goods to the Seller without delay, but no later than 14 days after sending the cancellation form to the online store. Upon receiving the returned goods, the online store will immediately, but no later than 14 days, refund all payments received from the buyer based on the Distance Contract.

The Seller has the right to withhold payment until it has received the Goods or confirmation of the return of the goods from the Buyer. If the buyer has chosen a shipping method other than the cheapest shipping method offered by the online store, the online store is not obliged to compensate for the excess shipping costs.

The online store is not responsible for delays in fulfilling obligations or for non-fulfillment, or any other type of non-fulfillment, arising from circumstances and obstacles that are beyond the reasonable control of the online store.

The online store reserves the right to refuse to sell goods and request the return of goods from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.

6. Consumer rights regarding non-conforming goods

The online store is responsible for the non-conformity of goods sold to the Buyer with the terms of the contract or for defects that occurred within 6 months after the delivery date to the customer, or that existed at the time of delivery, unless such an assumption contradicts the nature of the matter or the defect. The Buyer must inform the Seller about the non-conformity of the goods immediately, within 2 months after its discovery, t.i. , and submit a complaint. The Buyer can submit a complaint by contacting the online store, writing to livly.livagoba@gmail.com.

The online store is not responsible for defects that occurred after the delivery of goods to the Buyer.If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the rectification of the goods' defects or exchange them for new goods free of charge.

If the goods cannot be repaired or replaced, the Seller will refund the Buyer all payments specified in the Distance contract. The Seller will provide a written response to the consumer's complaint within 15 days.

7. Processing of the Buyer's personal data

The online store processes only the personal data that the buyer has entered when ordering goods, such as name, surname, email u.c.

The online store transfers personal data to the transport service provider(s) to ensure the delivery of goods.

If you have explicitly agreed to receive our marketing communications, including news, we may occasionally contact you by sending information about our services and the latest offers.For this purpose, we may process your email address that you provided when signing up for marketing communications. The Buyer has the option to opt-out of marketing notifications by notifying us by writing to livly.livagoba@gmail.com.

8. Dispute Resolution Procedure

In matters not covered by these terms and conditions, the Buyer and the Seller agree to comply with the regulatory acts in force in the Republic of Latvia.

The parties resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the parties will resolve the dispute in the courts of the Republic of Latvia, in accordance with the regulatory acts of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be submitted for resolution to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.

The Buyer has the right to also appeal to the European Union dispute resolution bodies.
